If a child of mine tosses a struck match into a gasoline can, I don't praise him because the thing didn't blow up-  even if he says "Gee, I'm sorry!"

The gasoline is already on fire. They reported erroneously on the extent of the flames.

The worst analogy here is kicking the dog.  Harming a dog is bad to begin with.  You don't need the dog to bite to know that.  Plus, the law generally protects animals from cruelty. 

This case is the opposite.  The law protects free speech.  The law does not protect people from getting their feelings hurt.
